Terms & Conditions

These terms and conditions apply to the DictaOne app (hereby referred to as "Application") for mobile devices that was created by Technology Company Limited (hereby referred to as "Service Provider") as an Ad Supported service. This service is intended for use "AS IS".

1. Acceptance of Terms

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

2. License Grant

Subject to these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes.

3. Privacy

Your use of the Application is also governed by our Privacy Policy, which describes our data practices. By using the Application, you agree to both these Terms and our Privacy Policy.

4. Age Requirements

• Users must be at least 13 years old to use the Application independently
• Children under 13 may use the Application under parental supervision
• Parents are responsible for monitoring their children's use

5. App Functionality and Data

The Application operates entirely on your device with the following characteristics:

• All text input and dictation materials are stored locally on your device only
• Text scanner captures are processed locally and not transmitted to external servers
• Text scanning functionality requires camera permission for image processing
• Camera data is processed using on-device ML services
• The Service Provider is not responsible for any loss of saved dictation materials
• Users are responsible for backing up their own content
• The Service Provider makes no guarantees about the accuracy of text-to-speech functionality or text recognition
• Password protection features are dependent on user implementation and device security
• No data synchronization or cloud backup is provided

6. User Content

• You retain ownership of all content you create
• You grant the Service Provider no rights to your content
• All content remains on your device only
• You are responsible for content legality and copyright compliance
• Users are responsible for ensuring they have rights to photograph and scan text materials
• The Service Provider is not responsible for any copyright violations from user-created content or scanned materials
• Users should ensure they have rights to use any text they input for dictation purposes
• The Service Provider is not responsible for the accuracy of translations, language learning outcomes, or text recognition results
• Users must comply with local laws regarding photography and text scanning

7. In-App Purchases

• The Application offers in-app purchases for additional features
• All purchases are processed through Apple App Store or Google Play Store
• Prices may vary by region and are subject to change
• Purchases are non-transferable between platforms
• Refunds are subject to Apple/Google policies

8. Analytics and Advertising

The Application:

• Displays third-party advertisements
• Collects anonymous usage analytics
• Uses advertising IDs for ad personalization
• You can opt-out through device settings

9. App Updates and Modifications

The Service Provider may update the Application at any time. We will notify you of material changes through:

• In-app notifications
• Update notices in app stores
• Email (if provided for support)

Updates may include:

• Changes to available features and functionality
• Updates to supported languages for dictation and interface
• Modifications to the user interface and user experience
• Changes to ad display and advertising services
• Updates to text recognition functionality and accuracy
• Security updates and bug fixes

Continued use after changes constitutes acceptance. Some updates may require additional permissions or change how data is stored locally.

10. Third-Party Services

The Application utilizes the following third-party services:

• Google Play Services (Android)
• Apple iOS Services (iOS)
• Google/Apple payment processing
• Google AdMob/Apple advertising services
• Google ML Kit/Apple Vision (for text recognition)
• Firebase Analytics (for anonymous usage analytics)

These services are subject to their own terms and conditions. Users should review the privacy policies and terms of these services independently.

11. Technical Requirements and Limitations

• The Application requires adequate device storage for local data storage
• Text scanning functionality requires camera access permission
• Some features require an active internet connection for advertisements and analytics
• Device performance may affect text recognition accuracy and speed
• The Service Provider is not responsible for:
  • Data charges from your mobile provider
  • Battery consumption during app usage
  • Device performance issues or compatibility problems
  • Storage limitations or insufficient device memory
  • Camera hardware limitations affecting text scanning
  • Operating system compatibility issues

12. Limitations of Liability

The Service Provider is not liable for:

• Loss of saved dictation materials due to device issues or user actions
• Accuracy of text-to-speech conversion or voice synthesis
• Accuracy of image text recognition or OCR results
• Learning outcomes, educational results, or language proficiency
• Device storage issues or data corruption
• Password recovery or forgotten access credentials
• Data backup or recovery services
• Camera functionality issues or hardware problems
• Interruptions in service due to device or network issues

13. Indemnification

You agree to indemnify and hold harmless the Service Provider from any claims, damages, or expenses arising from your use of the Application or violation of these Terms.

14. Termination

The Service Provider may terminate your access to the Application at any time without notice. Upon termination:

• All rights granted under these terms will cease immediately
• You must stop using the Application and delete it from your device
• All local data may be lost upon application deletion
• No refunds will be provided for any paid features

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Hong Kong. Any disputes shall be resolved through good faith negotiations, and if necessary, through the courts of Hong Kong.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Service Provider regarding the use of the Application.

13. 賠償

14. 終止

服務提供商可能隨時無通知終止您對應用程式的存取。終止後：

• 在這些條款下授予的所有權利將立即停止
• 您必須停止使用應用程式並從裝置中刪除它
• 應用程式刪除後可能會遺失所有本機資料
• 不會為任何付費功能提供退款

15. 適用法律和爭議解決

16. 可分割性
